Buying of Invermere Lakefront Property

On the 16th of August 2018, the city council held a meeting to discuss purchasing a section of the Invermere Lakefront. This portion has critical access to all the recreational opportunities in this locality.

The area under consideration spans 14 acres, including garage lands, resort area, boating storage region, and marine lease. Also, the lands of Lake Windermere Resort and Athalmer are the real gateways to this community.

These Invermere lakefront properties provide public access to places like Columbia River Wetlands and Lake Windermere. In the year 2019, the District of Invermere purchased the lands for Lake Windermere Resort. As a result, the intention was to provide the public with better access to the lake and its vicinity. The District decided to purchase the land-based on 66% of the voters in the municipal elections in 2018. These voters suggested investing in this area. As a result, the District is planning to move ahead with Athalmer and its neighborhood plan.

The District of Invermere has awarded the B&A Planning Group contract with support from McElhanney Consulting Services in this area’s development process. Also, it includes the lands of Lake Windermere Resort. This project includes land usage, planning for infrastructure, resort and land design concepts, residential areas, and a commercial corridor. In this regard, a public consultation will begin soon.

Invermere’s council members got a project update by the committee of the June 9th committee of the whole meeting. Conclusion B&A provided the committee with a list of three options based on impact levels with a wide spectrum of choices.

2.Marina Expansion – formal boat launch area, commercial /retail opportunity, public parking.
3.Public Event Space (Amphitheatre).
4.Mixed-Use – Residential/Commercial.
5.Residential /Neighborhood Opportunity.
6.Commercial Kiosks related to public waterfront access.
7.Waterfront Trail/Pathway to Downtown and Public Water Access.

Option #3

The highest impact options were called Bustling Resort and included-

1.Columbia Wetlands Interpretation Platform and boardwalk.
2.Marina Expansion – formal boat launch area, commercial /retail opportunity.
3.Public Event Space (Amphitheatre).
4.Public Parking.
5.Intensive tourism development, possibly in the form of hotel-commercial blocks up to 12 stories high.
6.RV/Boat Storage.
7.Waterfront Trail/Pathway to Downtown and Public Water Access.

B&A highlighted that there is a tradeoff as well. By selling pockets of public lands to the private sector, it is necessary to develop the amenities listed above. Above all, it is public land; a significant amount of ROI is expected. Therefore, more development essentially means that more money is needed for amenities and parklands. But the additional development also comes at a cost.

New Invermere home for sale

BC Government created a home exemption that will affect New Invermere home for sale.

The newly developed home exemption by the BC government is geared towards eliminating/reducing the property transfer tax amount that you pay during the purchase of a New Invermere home for sale.

According to the details of this exemption, a new Invermere home for sale is,

  • Any Invermere home developed as well as affixed vacant land.

  • Any new apartment within a newly developed condo building.

  • A manufactured Invermere home situated on vacant land.

  • Any Invermere house that has been already constructed but removed from vacant land. It hasn’t been occupied since it was constructed on the new fragment of vacant land.

  • Any Invermere house that results from a division of a current improvement to a fragment of land that was subdivided. But the house has not been occupied since the subdivision of the fragment of the land.

  • An Invermere house converted from a current improvement on a fragment of land while the previous improvement couldn’t be used for residential purposes. Also was used for commercial purposes.

If you qualify for an exemption, you will be eligible for full or partial tax exemption if you have already paid the property transfer tax when purchasing the vacant land. Therefore you have a new home on that fragment of land. Then you are eligible for a refund of the tax that you paid.

For the tax exemption qualification, the property transfer (either involving land or improvement) must be registered after Feb 16, 2016, at the LTO (Land Title Office). And for this,

  • It would be best if you were an individual.
  • You must be the holder of Canadian citizenship or permanent residency.

Your Social Insurance Number will be required along with your date of birth for confirmation purposes. While

  • The property must be located in British Columbia.
  • It should be only for your principal residence.
  • The property needs to have an FMV of $750000 or less.
  • It needs to be 1.24 acres in size or smaller.

You will qualify for a partial exemption if,

    • The property has an FMV greater than $750000 and less than $800000.
    • It is larger than 1.24 acres.
    • It has another building separate from the principal residence.

How to apply?

You need to select/enter the exemption code 49 while filing the Return for the Property Transfer Tax for the newly developed home exemptions in Invermere, BC.

Requirements of Occupancy for New Invermere homes for sale.

Once you’ve registered your property, you have to meet all the occupancy requirements within your ownership 1st year. To keep the tax exemption,

  • You must move in within 92 days from the date when the property was registered at the LTO.
  • Also, you must continue to occupy this property as a principal residence for the remaining part of that 1st

You will receive a letter from the LTO to confirm that you meet these requirements. You might keep a portion of the exemption if you moved out before the end of the 1st year, but you will have to repay this amount before the 1st year.

Refund

Suppose you’d qualified for the tax exemption. But it didn’t apply when you registered the property at the LTO. Then you can apply for a refund as well.

The BC Goods and Services Tax (GST) for real estate in Invermere is 5 percent Federal Tax. This is payable upon successful sale completion of all brand new real estate properties in Invermere, BC. Therefore, GST is only payable on the newly developed Invermere real estate properties.

These include an Invermere condominium development on pre-sale sold by any developer or the builder and owner of that condominium development. The property needs to be detached concerning who is going to be the payer of GST. It also implies that the purchased contract assignment from another entity is also subject to Invermere real estate BC GST.

When is the GST due on a property?

The Goods and Services Tax is due right at the completion time according to the sale/purchase contract. Your lawyer or notary will calculate it when the statement of adjustments is being prepared for completion.

General GST rebate for real estate in Invermere

There is a general rebate available for those properties that are less than $350,000 in price and if the buyer is looking to live permanently. The general rebate here is 36% of the 5% GST value. This is the highest amount of rebate that can be issued for any new property.

The purchases that fall between $350,000 and $450,000 also have a partial rebate, but that is significantly low. However, the properties over $450,000 do not receive any rebates, even for new homes.

Do I need to pay GST on my real estate in Invermere?

This is a dubious question because it solely depends upon your current purchasing status and, of course, the type of property you are buying.

  • If you are looking to purchase a used residential property in Invermere, GST will not apply here.
  • Suppose the price of a new home is under $350,000. Then you will only have to pay 36% of the 5% GST. This scenario is also applicable if you are looking to buy a pre-sale property.
  • In the case of a contract assignment, the property is considered a new home, and 36% of 5% GST will be applicable if its value is under $350,000 unless agreed otherwise.
  • In the case of rentals, the GST rental rebates are also available, but the purchaser will have to pay a full 5% of GST.
  • As a buyer in Invermere, you will have to pay GST for your transaction services. As a seller, you will pay GST on the commissions of your listing agent.
  • If the purchase price already includes the GST. As a result, you won’t have to pay for it again.

Is the assignment of contracts subject to paying GST?

Yes. Assignment of contracts is still considered a new home, so you will be paying the GST upon completion unless otherwise agreed to between the assignee and the assignor.

Are there any rental rebates?

If a Purchaser is planning to rent out the new home, they may be eligible for a GST New Residential Rental Rebate. Like the GST New Housing Rebate, the full GST NRR Rebate is only available on new homes
priced up to $350,000. A partial GST NRR Rebate is available for homes priced between $350,000 and $450,000. More information on the GST New Housing rebate can be found at this link. 

To be eligible for the G.S.T. NRR Rebate, the Purchaser must meet certain conditions, which include:

1. The Purchaser must not be entitled to claim input tax credits in respect of any part of the tax payable on the rental unit’s acquisition.
2. The rental unit must be a “qualifying residential unit,” Which means the person applying for the rebate must be the owner of the unit, and the unit must be a self-contained residence as defined in the Excise Tax Act;
3. The unit must be held by the owner to make exempt supplies (for example, a residential tenancy);
4. The unit must be used as a primary place of residence by the tenants and must be so used for at least one year, and the Purchaser will have to provide a copy of the tenancy agreement showing a term of at least one year.

Please note that the Developer cannot credit the Purchaser on completion with the GST NRR Rebate. This means the Purchaser will have to pay the full 5% G.S.T. on completion. Then claim the G.S.T. NRR Rebate afterward directly from Canada Revenue Agency.

District interested in Invermere Lakefront property for sale?

When there was some Lakefront property in Invermere for sale, the Invermere District looked forward to buying it. The Mayor of Invermere, Al Miller, referred to it in the East Kootenay Regional District meeting in January.

It is one of the major items from Invermere’s financial plan for 2019 to 2023. This area is about 14 acres in size, and it includes the resort area, garage lands, marine lease, and the region where the boat storage is present.

The discussion on this topic began regarding a boat launch in this location. The CAO of Invermere District, Chris Prosser, conducted a land survey and found that most of the land was private. For the boat launch, it needed to be bought.

When Invermere District approached the owners, they refused. They were not interested in selling the land in small parcels but would like to sell it as a whole. The area went back and forth with plenty of offers rejected. At first, the owner wanted $10 million for this piece. But later on, it went for around $5 million Lake Windemere lakefront.

Why did the District buy Invermere Lakefront Real Estate?

Now, Invermere District owns the Invermere Real Estate Lakefront at the beach of James Chabot. In one of the polls in the municipal election last year, more than 65% of voters favored spending $5 million for the purchase. This was what the final bill also had in September.

The Mayor said that this was the least that we could go. It has turned out to be a pretty good deal. He also added a short-term $5 billion loan for the next 5 years with the Municipal Finance Authority. Now the authorities are in the planning stage where the District can sort out the funding streams and began the procedure. The mayor is looking for any partnership donations, funding streams for this sum. For setting out the loan in a longer time period, the District can reduce any amount they get in.

He also mentioned that this is not a risky strategy for buying land before any funding resources. He says that different funding sources or grant opportunities will help pay the debt. Later on, it would be feasible to go for a lesser amount of long-borrow.

The mayor also mentioned that Invermere would look for new opportunities for undoing some costs to taxpayers. He also added other opportunities available for funding CBT (Columbia Basin Trust), the provincial and federal government, and some very generous philanthropists.

It depends on what the people of the area want to see, and the Invermere District can go for some assistance from the hotel and condo developers. The Mayor also mentioned that the District also needs to reach a consensus to be sure what needs to be on Invermere’s resort lands.
